Foreclosure Sale Notices

Properties are generally advertised in local news papers and appear once for each of the six weeks prior to the date of sale and they are also listed on the Green County Sheriff website. Written notices are also posted in the town or municipality where the real estate is to be sold.
The Sheriff's office does not have any specific information regarding the property. Foreclosure sales are for real property only. The Sheriff's Office does not know whether or not persons occupy the property.
All Sales are subject to cancellation or rescheduling up until time of sale. If you need to cancel or adjourn a sale you may fax information to 608-328-1823.
Sheriff Sales will be conducted on Thursdays at 9:30a.m.
The Green County Sheriff's Office does not have specific information regarding the condition of the property being sold. Persons Interested In Obtaining Information About A Property Are Encouraged To Contact The Plaintiff Or Their Attorney Of Record.
Sales of Property are "open-type" auction sales with the plaintiff normally submitting the opening bid. Anyone at the auction can bid on the property, with the property going to the highest bidder. If you are seriously interested in purchasing the property, you may want to contact a title company or attorney to perform a title search. Questions on the legalities of purchasing a foreclosed home should be directed to an attorney and it is the buyers responsibility to have the occupants legally removed if the property is occupied.
Third party bidders are to have 10% of their bid in cash or bank-certified funds, made payable to the Green County Clerk of Courts, at the time of the sale and the balance will be due following the confirmation of sale hearing. The bidder is responsible for any and all legal encumbrances on the property, ie real estate taxes, etc.

846.155 Eligible bidders at foreclosure sales; affidavit required for confirmation; penalties for false representation.
(2) MINIMUM BIDDER QUALIFICATIONS. No 3rd-party bidder may submit a bid at a sale of mortgaged premises unless the 3rd-party bidder meets all of the following qualifications:
(a) The 3rd-party bidder does not own an interest in property in this state against which taxes have been levied that are more than 120 days delinquent.
(b) The 3rd-party bidder is not directly or indirectly owned, managed, or controlled, in whole or in part, by a person that owns an interest in property in this state against which taxes have been levied that are more than 120 days delinquent.
(c) The 3rd-party bidder does not directly or indirectly own, manage, or control, in whole or in part, an entity that owns an interest in property in this state against which taxes have been levied that are more than 120 days delinquent.
(d) No judgment against the 3rd-party bidder related to a violation of a state or local building code with respect to property in this state has been rendered that is unsatisfied.
(e) No judgment against a person that directly or indirectly owns, manages, or controls, in whole or in part, the 3rd-party bidder related to a violation of a state or local building code with respect to property in this state has been rendered that is unsatisfied.
(f) No judgment against an entity directly or indirectly owned, managed, or controlled, in whole or in part, by the 3rd-party bidder related to a violation of a state or local building code with respect to property in this state has been rendered that is unsatisfied.
(g) In submitting a bid at the sale, the 3rd-party bidder is not acting on behalf of or as part of an agreement with a person that does not meet the qualifications described in pars. (a) to (f).
The Sheriff requires that all 3rd party bidders shall submit a notarized affidavit in acknowledgement of these terms prior to bidding.
